Nacho Cano files a complaint for prevarication against the judge who investigated him.

Music producer Nacho Cano has filed a complaint for alleged malfeasance against the judge who investigated him for alleged crimes against foreigners and workers, after the Madrid Provincial Court closed the case after seeing no evidence of a crime .

In the complaint filed with the Superior Court of Justice of Madrid (TSJM), to which EFE has had access, Nacho Cano 's lawyers argue that the judge, who retired in August upon turning 65, engaged in "arbitrary" actions and failed to respect the rights of the suspect .

They particularly emphasize that the Provincial Court ordered the investigation to be closed last April .

The judges made this decision due to the " lack of rational evidence " that Cano and other suspects committed crimes against workers' rights , considering that he did not attempt to illegally bring young Mexicans into the country to work as interns on his musical "Malinche."

At that time, Nacho Cano announced that he would file a complaint against Judge María Inmaculada Iglesias , which his lawyers have now filed, arguing that the decision by the higher court confirms that "from the outset, there was sufficient evidence to agree to dismiss the proceedings and even to not initiate any Preliminary Diligence ."

But instead, the judge "chose to order a series of unnecessary and impertinent proceedings with the sole purpose of prolonging the investigation " and keeping Cano charged, "suffering the social condemnation of the well-known ' penalty of the bench ' with the moral damage and discredit that this causes."

Among the alleged irregularities they argue, Nacho Cano's lawyers emphasize that the judge ordered the Labor Inspectorate to prepare a second report on the Mexican interns of the musical Malinche , which was to be done by a different inspector than the first, in which irregularities were ruled out .

This represents - they maintain - " a partial and subjective decision , because their only interest is to obtain a report that concludes what His Lordship has in mind, and that is to prove the evidence of the crime that is being investigated because the judge is already prejudging , all of this contrary to what is provided by law."

For the music producer, it is clear that the entire case is based on a false complaint from an intern at the musical, according to sources close to him, who specify that his intention in filing a complaint against the judge is " to determine responsibility and protect all citizens from arbitrary and unfair judicial and police actions ."

"This is not an attack on the judiciary , but rather an exercise in defense of fundamental rights : the presumption of innocence , self-defense, and a fair trial ," they added, emphasizing that the judge has already retired.

In December 2024, the Madrid High Court rejected a complaint filed by Nacho Cano against the judge for irregularities in the investigation , as the judges of the high court found that the case did not meet the legal requirements and that the alleged crime was not established.
