Argentine NewsThe jury trial against nurse Dahiana Gisela Madrid , one of the accused in the death of Diego Armando Maradona , was provisionally suspended until the Criminal Court (TOC) No. 7 of San Isidro rules on whether the nullity of the technical debate extends to this process.
Sources involved in the case reported that the parties will wait for the new members of this court to rule on whether this trial can also be declared void.
The suspension was requested this Thursday at the preliminary hearing by prosecutors Patricio Ferrari and Cosme Iribarren, while plaintiff attorneys Mario Baudry (legal representative of Verónica Ojeda and Dieguito Fernando) and Fernando Burlando (Dalma and Gianinna) joined in.
Martín Miguel De Vargas, one of the nurse's defenders, spoke with NA and denounced the other parties' "delaying tactics" to prevent the debate against Madrid from taking place.
"They are acting recklessly and maliciously because they want to harm the defendant, who has been unable to leave the country for five years and is unemployed," the lawyer said.
For his part, Rodolfo Baqué emphasized that the injured parties and representatives of the Public Prosecutor's Office petitioned for annulment, but Judge María Coelho—head of the 7th Criminal Court—rejected it. "We are going to ask the Buenos Aires Attorney General's Office to intervene to investigate the parties," Baqué stated.
How the trial for Maradona's death continuesThe draw for the new judge who will replace Alejandro Horacio Lago will be held next Tuesday after he recused himself due to health problems .
On June 19, the drawing of lots was held, confirming that San Isidro Court No. 7 will be in charge of the new trial after the first hearing was declared void due to the production of an unauthorized production, which was presided over by Judge Julieta Makintach (preemptively removed from her position). The presiding judges were Roberto Gaig, Alejandro Lago, and Alberto Ortolani.
With the temporary suspension of the jury trial confirmed, delays continue in uncovering the truth and determining the defendants' potential responsibilities.
In addition to Madrid, the following people are accused of the alleged simple homicide with eventual intent to commit the crime of murdering the Argentine star: neurosurgeon Leopoldo Luque, psychologist Carlos Díaz, psychiatrist Agustina Cosachov, nurse Ricardo Almirón, his coordinator, Mariano Perroni, clinical doctor Pedro Di Spagna, and the head of Diego's home care in Tigre, Nancy Edith Forlini.
If found guilty, those investigated could receive sentences of between eight and 25 years in prison.
