Federal justice is investigating Cristina Kirchner for the "southern zone" bonus she received while living in the Federal Capital

The ANSES complaint against Cristina Kirchner for having collected the additional supplement of 6 million pesos per month in the two pensions she received for having settled her domicile in Río Gallegos while living in the Federal Capital, was left in the hands of federal prosecutor Gerardo Pollicita. With a previous presentation to his prosecutor's office, he decided to open the investigation to clarify the facts. The crimes for which the former vice president was accused are fraudulent administration, fraud, and ideological falsehood.
Federal prosecutor Franco Picardi, who received the latest complaint from ANSES against Cristina Kirchner, decided to send everything to his counterpart at Comodoro Py, who had already received another complaint accusing the former vice president of similar acts.
Pollicita decided to launch an investigation to determine whether Cristina had committed any crime or not.
When the Fourth Chamber of the Federal Court of Criminal Appeals confirmed the conviction for fraudulent administration to the detriment of the State in the Roads case, the government decided to take away the privileged pension she received , along with the one she was paid as the widow of former President Néstor Kirchner.
According to official figures, the former president received a total of 21,827,624 pesos from the two pensions she received as a former president and widow of another head of state. Since December, Cristina has stopped receiving that money.
This claim was joined by another decision of the libertarian government: the Ministry of Human Capital, led by Sandra Pettovello, made a presentation in the Comodoro Py courts in which the former president is accused of "alleged fraud, defrauding the State and ideological falsehood" for having collected the Southern Zone Bonus in her two pension benefits when "her residence in CABA is public knowledge."
The alleged crime of ideological falsehood, according to the complaint, is due to the decision to have declared a domicile in the southern zone that did not correspond to his permanent residence. "This, in order to be able to collect a monetary supplement to his privileged allocations. This would have generated a fiscal loss to ANSES , for which, in addition, the organization requests to be a plaintiff in the case."
After analyzing the complaints, Pollicita decided to open an investigation. The prosecutor requested a series of documents from Capital Humano related to the granting of special benefits, which include, for example, the additional benefit for the southern zone.
The representative of the Public Prosecutor's Office also requested that the ministry to which ANSES depends provide details of the number of months in which Cristina Kirchner received the additional payment in question and the final amounts corresponding to said period.
In the details of the complaint, the ministry headed by Pettovello stated that "the bonus for the southern zone, according to the explanatory statement of Law 19,485, aims to ' contribute to the program of settlement and demographic growth of the southern region of the country, enabling its regional development and attending as a priority to the social needs derived from the higher cost of living .'"
When justifying this point, it was emphasized that Law 19,485, its extensions and amendments detail which are the provinces and zones in which those who receive benefits with application of the bonus coefficient for the Southern Zone must be located - provinces of Río Negro, Neuquén, Chubut, Santa Cruz, La Pampa, Tierra del Fuego and the Carmen de Patagones District of the Province of Buenos Aires -".
The legal framework maintains that the Southern Zone Bonus has "cause and foundation in a state policy whose basis is to promote the development of a certain region through its population."
The criminal complaint was filed after ANSES rejected the requests made by Cristina Kirchner and Amado Boudou, with which they sought to recover the monthly lifetime allowances that were taken away from both of them last year.
