At the evening celebrating the 10th anniversary of the Pampelonne beach development plan, Mayor Roland Bruno arrived with " good news ." The legal proceedings that threatened the operations of ten beach establishments are over. Indeed, on July 15, two days before the anniversary ceremony, the Council of State dismissed a former private beach manager's request for the termination of 10 sub-concession contracts, claiming he had been unfairly disadvantaged when the lots were awarded.
Let's retrace this legal saga that has caused both the municipality and the operators to sweat. The dispute dates back to 2018 when the applicant, Le Chalet des Jumeaux, sued the municipality before the Administrative Court, which rejected the request. But in 2022, the Administrative Court of Appeal decided to terminate the 10 lots. Then, after an appeal, the Council of State reversed course, overturned the decision, and referred the case back to the Court of Appeal.
The latter, in 2023, reversed the trend and ruled in favor of the municipality and its concessionaires. The applicant, like his opponents earlier, appealed to the highest court. The marathon ended there, the Council of State closed the case, considering that the procedure for awarding beach operations was regular.
With all avenues of appeal having been exhausted, the former beach attendant's fight ends here. Peace has thus returned to the ten establishments and the municipality that were in the hot seat.
