The Court of Cassation has overturned the dismissal of proceedings issued by the Pavia court in proceedings concerning alleged irregularities in secondary medical transport contracts in the province of Pavia. The ruling concerns the former general director of the Pavia Local Health Authority (ASST), Michele Brait (pictured), official Davide Rigozzi, the then-representative of the cooperative involved, Luigia Milano, and her brother, Angelo Milano. The ruling also covers former directors of the cooperative, Antonio Calderone, Francesco Calderone, and Concetta Calderone, who had been brought to trial for other charges, only for the charges for which they were acquitted.
In December 2024, the Pavia court annulled the Milan Court of Appeal's order ordering the trial of all defendants, following the objection raised by lawyers Marco Casali and Lorenzo Bertacco, representing Brait and Rigozzi, who pointed out the late filing of the appeal by the Prosecutor's Office. The prosecutor subsequently appealed the decision to the Supreme Court of Cassation. The Supreme Court upheld the appeal on Tuesday and consequently overturned the Pavia court's dismissal of the case and ordered the defendants to return to the Court of Appeal. The reasons for the decision are now awaited to clarify the technical aspects of the case.
