Visibilia: one charge nullified, prosecutor 'risk of statute of limitations' on Santanché (2)

(Adnkronos) – In just over an hour of hearing, the Milan Court has just enough time to reconsider a charge already revised by the prosecution, but not enough for the company, which is expected to answer under Law 231 on corporate liability. And faced with a section that will have two new judges in September, the panel chaired by Giuseppe Cernuto has decided to stall and not rule on the request of lawyer Federico Cecconi—who represents some of the defendants—to exclude the three civil parties, because "the minority shareholders have not suffered any direct damages," a condition for admissibility.
But prosecutor Marina Gravina intervened on the postponement, requesting that "the matter be decided today or before the summer, also in the interests of justice and the reasonable length of the trial, which at this pace risks going too far," with the risk of incurring the "statute of limitations," given that in some cases the false accounting concerns 2016.
A request that was denied. The presiding judge noted that the vaguely worded indictment had an impact in the courtroom, and emphasized that "this phase must be handled in a reasoned manner" and that "the Court has other matters to address, not just this trial." The return to court is scheduled for September 16th.
