The Civil Guard's Traffic Unit routinely places mobile devices on Spanish roads to intercept drivers exceeding the speed limit . Last July, officers from the Civil Guard spotted an individual traveling at 188 km/h on the N-211 in the municipality of Monreal del Campo (Teruel), but they were surprised when they stopped the driver.

In this case, members of the Civil Guard verified that the individual had lost his driving license , so they initiated the proceedings that were handed over to the Court of Instruction of Calamocha (Teruel), for the alleged commission of two crimes against Road Safety , as specified by Diario de Teruel .

What crimes could this individual face?

First, the driver could be prosecuted for committing a crime under Article 379 of the Spanish Penal Code for driving "a motor vehicle at a speed exceeding the legal speed limit of 80 kilometers per hour on an interurban road."

Likewise, another offense specified in Article 384 will also be investigated: "Anyone who drives a motor vehicle or moped in cases where the permit or license has become invalid due to the total loss of legally assigned points."

Criminal consequences of these crimes

Article 379 stipulates that drivers could be punished with "a prison sentence of three to six months, a fine of six to twelve months, or community service of thirty-one to ninety days, and, in any case, deprivation of the right to drive motor vehicles and mopeds for a period of more than one and up to four years."

Article 384, for its part, establishes a punishment of "a prison sentence of three to six months, a fine of twelve to twenty-four months, or community service of thirty-one to ninety days."

How are speeding penalties evolving on roads with a 90 km/h speed limit?

The first table of Annex IV of the Traffic Law specifies the amount to be paid and the points to be deducted in the event of speeding recorded by a speed camera and divides it according to the speed limit on the road; for 90 km/h it is as follows:

  • From 91 km/h to 120 km/h; 100 euro fine .
  • From 121 km/h to 140 km/h; 300 euros and a deduction of 2 points.
  • From 141 km/h to 150 km/h; 400 euros and 4 points.
  • From 151 km/h to 160 km/h; 500 euros and 6 points.
  • Over 161 km/h; 600 euros and 6 points .
