Lázaro Báez's defense team requested a new hearing to review the conditions of his detention.

The defense team for businessman Lázaro Báez appeared before the court on Monday to request that the Fourth Federal Oral Court move forward with the new sentence and review the businessman's detention conditions. Báez's legal team argued that the businessman convicted in the Highways Case is being held in conditions that have deteriorated his health.
The request dates back to the Federal Court of Criminal Cassation 's last ruling, when the Court was ordered to recalculate Báez's sentence after the sentences for the " Ruta del dinero K " and " Vialidad " cases were consolidated. Despite the lawyers' insistence, the judges determined that "it is not possible to determine how much of Báez's sentence has already been served since his first arrest until now, since no calculation was made at the time the sentences were consolidated."
On the other hand, the Supreme Court opened the possibility of re-discussing the length and method of Báez's sentence. Therefore, the defense could insist on its request for the 68-year-old businessman to be granted house arrest, which he was serving prior to the Supreme Court 's confirmation of his conviction in the Vialidad case. According to his lawyers, Báez "has been continuously serving some form of precautionary measure restricting his personal freedom since 2016."
One of the arguments they cited was prosecutorJavier De Luca 's position before the Supreme Court, which stated that "judges cannot omit the period a convicted person spent in pretrial detention in the same case they are trying, which for formal reasons has been split into segments." The brief also asserted that Báez had no violations of his sentence while under house arrest. "The aggravation of the sentence serving method can only be justified in the face of noncompliance by the convicted person," they emphasized.
The petition also requests an expanded report on the businessman's detention conditions, housing, food, and current health status. This request is based on the allegation that, since his arrest, Báez has been permanently housed in a cellblock, held incommunicado for periods of up to six hours, and allowed 30-minute breaks outside his cell two or three times a day. It also notes that he has recently suffered various health episodes, the most recent dating back to June 26.
