Today I have sent another letter to the National Electoral Commission, Minister of Finance Andrzej Domański informed on Monday, adding that he expects clarification of the legal doubts that appear in the resolution regarding the payment of money to Law and Justice.

On January 8, the Minister of Finance, Andrzej Domański, sent a request to the chairman of the National Electoral Commission, Sylwester Marciniak , asking for clarification of doubts regarding "the content and legal effects of the National Electoral Commission Resolution of December 30, 2024 ".

In a letter sent on Monday, Domański noted that the National Electoral Commission has not yet provided the expected explanations.

"Today I sent another letter to the National Electoral Commission. I am waiting for clarification regarding the internally contradictory Resolution, in accordance with the motion of January 8, 2024," the Minister of Finance informed Platform X.

Domański wants explanations from the National Electoral Commission

In the published letter, the minister informed that on 3 February he received a letter from the chairman of the National Electoral Commission calling for the urgent implementation of the Resolution. The Commission also provided him with minutes of three meetings held in January and February.

Instead of the position of the National Electoral Commission, the ministry was to receive the opinions of three of its members.

Domański maintains his position and claims that the NEC Resolution of December 30, 2024 is internally contradictory, so there is no formal possibility of its implementation . This means that PiS will not receive the money.

"An unprecedented situation"

"This situation is unprecedented in the previous constitutional practice of the National Electoral Commission ," the minister noted. As he emphasized, even the members of the Commission themselves were unable to reach a consensus on whether the resolution should be implemented or not.

"The inclusion by the National Electoral Commission in the Resolution of paragraph 2 with the content specified therein clearly indicates that the National Electoral Commission itself has serious doubts as to whether the complaint of the Electoral Committee was resolved by the Supreme Court within the meaning referred to in the Constitution and the Electoral Code," he stressed.

The National Electoral Commission stated in paragraph 2 of this resolution that it " does not prejudge (...) that the Chamber of Extraordinary Control and Public Affairs of the Supreme Court is a court within the meaning of the Constitution of the Republic of Poland" and "does not prejudge the effectiveness of the ruling ".
