Verdict in the threat and insult case against the Minguzzi family

While defendant Çınar Diril, who is in custody, connected to the hearing at the Bakırköy 8th Criminal Court of First Instance via the Audio and Video Information System (SEGBİS), Diril's parents and the lawyers for both sides were present in the courtroom. Minguzzi's mother, Yasemin Akıncılar Minguzzi, and father, Andrea Minguzzi, did not attend the hearing.
At the hearing, it was stated that the report prepared after examining the computer of the detained defendant Diril was included in the file.
The report stated that it was determined that the computer had been formatted, and that the computer contained the remains of the number from which the threatening message had been sent to the family, but it was not clear how the recording was created.
YEG, who testified at the hearing, said he knew one of the defendants, Çınar Diril, saying, "We met through the game. I have information about the trial. I don't know whether Çınar committed the crime of threatening the Minguzzi family. I spoke with Çınar a few days before his arrest. I didn't discuss whether or not I should open a telephone conversation with Çınar; I don't know."
Evren Diril, the father of Çınar Diril, who was heard as a witness, stated that he did not format the computer, that he used the computer occasionally for research after his son was imprisoned, and that the recording could have been found because he searched for the phone in question on the computer.
The plaintiff's lawyer stated that Evren Diril had been in the courtroom from the moment the hearing began and that, for this reason, his statements should not be taken into account.
The prosecutor, who announced his opinion at the hearing, requested that Barış Ayata be sentenced to 7 months and 15 days to 3 years and 6 months in prison for the crime of "consecutive threats" and up to 2 years in prison for the crime of "praising the crime and the criminal"; and Çınar Diril be sentenced to 7 months and 15 days to 3 years and 6 months in prison for the crime of "consecutive threats" and up to 3 months and 22 days to 3 years and 6 months in prison for the crime of "insult".
Asked for his final words, defendant Diril claimed that he had not committed a crime and requested his acquittal and release.
Announcing its decision after a recess, the court sentenced defendant Çınar Diril to three years in prison for "consecutive threats" and two years and three months for "insult." Taking into account Diril's time in detention, the court ordered his release.
The defendant Barış Ayata, who was not in custody, was sentenced to 2 years and 3 months in prison for committing the crime of "praising the crime and the criminal" through the press.
The court acquitted Ayata of the charge of "threating more than one person."
From the indictmentIn the indictment prepared by the Bakırköy Chief Public Prosecutor's Office, it was stated that Mattia Ahmet Minguzzi, who was being treated in hospital after being stabbed on January 24, died on February 9, and that Minguzzi's father, Andrea Minguzzi, and mother, Yasemin Akıncılar Minguzzi, were listed as complainants.
The indictment emphasized that defendant Barış Ayata created fear by posting messages on a social media account targeting the complainants following Minguzzi’s death, and noted that the insulting and threatening messages were sent to the complainants through a social media application purchased by defendant Çınar Diril.
In the indictment, defendant Barış Ayata was asked to be sentenced to 2 to 7 years in prison for "threating with more than one person" and "praising the crime and the criminal," and Çınar Diril was asked to be sentenced to 2 years, 3 months to 7 years in prison for "threating with more than one person" and "insult."
