Employers want to prevent people from taking sick leave while on vacation.

"When you're sick during your vacation, you're no longer on vacation, you're just sick," insists Carole Grelier, head of Pépinière Grelier, which designs and maintains gardens in Les Sables d'Olonne (Vendée). This 50-year-old business owner pragmatically welcomes the decision of the Court of Cassation , which ruled on Wednesday, September 10, that an employee who falls ill during their paid vacation can postpone it upon presentation of a sick note. This is in line with European law, which considers that the right to paid vacation and the right to sick leave "do not have the same purpose," the court recalled in its press release. "Some will take advantage of the system, but those who still have a professional conscience will remain employed. It's up to the employee to be rational and not abuse it; I will be forced to adapt," says the woman, who employs eight people.
