Everything seems clear in this case. The driver stopped in a seemingly prohibited spot and received a 100 złoty ticket from an intervening city guard. He should have kept his mouth shut, paid the fine, and the matter would have been over. But not for Andrzej Narajewski from Krasice near Przemyśl, who believes the 100 złoty fine was unfair and has been fighting for his rights in the courts for many months. First, the district court in Przemyśl, and now the district court in Rzeszów, where the case has been transferred.

It was June 25, 2024. He drove to Mnisza Street to drop off his daughter, parked on the sidewalk next to building no. 8. He wasn't the only one, as several cars were parked on the same sidewalk. A moment later, a municipal police patrol arrived. And so it began...

– One of the officers fined me 100 złoty for – in his opinion – violating the no-stop sign, as indicated by the B-36 sign with the T-24 plate. After I identified myself incomprehensibly, he demanded that I show my driver's license, without providing the actual basis for the inspection. To address my doubts, he pointed to a nearby road sign on a curve in the street. I then stated that the sign was incorrectly located, placed in a misleading manner, set back from the edge of the road in a legally inadmissible manner, and indicating that it pertained to a different area, namely the area near the entrance to the private property of the Mnisza 8 Housing Community, as indicated by the sign.

– said A. Narajewski.

– Near the B-36 sign itself, approximately four meters from the edge of the road, on a box with municipal waste containers, there is a sign with the same B-36 sign and the words "parking prohibited" and the information below: "service road" and "under pain of calling the municipal police." There was also information with a graphic outline of the applicable distance using arrows in both directions and a distance of three meters.

– he added.

We checked. Sign B-36, meaning no stopping on Mnisza Street... it's unclear what area or terrain it refers to. A few years ago, it was located on building no. 8 and clearly stated that stopping was prohibited on the entire sidewalk. Now—for some reason, it's been moved a few meters further and—for the less observant—may suggest a prohibition on stopping behind... a municipal waste container box. The sign wasn't perpendicular to the roadway, with a possible deviation of five to ten percent...
